Businesses increasingly choose digital billboards and signs for advertising. As electronic signs gain in popularity, municipal bodies rely on existing ordinances or enact and enforce ordinances tailored to their use. Local governments must address the growing use of these signs on public and private property. Revenue sharing proposals from billboard companies to local governments pose additional challenges for municipalities (as well as opportunities).
Susan and her co-panelists will provide counsel to local governments with a review of the types of restrictions that local governments can impose on digital signs and billboards for advertising without violating the federal and State constitutions. The presentation will offer perspectives and guidance on these and other critical questions:
- What are the issues that counsel to local governments must consider in determining whether an ordinance regulating digital billboards and signs is lawful?
- What types of restrictions can local governments impose on digital and electronic signs and billboards?
- What are some best practices for municipal attorneys drafting local regulations governing electronic signs and billboards?
As Chair of the Firm’s Public Land Use and Zoning Practice Group, Susan handles land use, planning and zoning matters for governments. Her practice includes extensive constitutional law in her field, including land use and zoning decisions raising First Amendment issues, including sign codes, adult use regulations, and regulation of religious uses, Harris Act claims, comprehensive plan challenges and petitions for certiorari. Susan has held leadership positions in the Florida Bar’s Section for Environmental and Land Use Law and Section for City, County and Local Government Law. An AV-rated attorney, Susan has been recognized as one of the top land use attorneys in Florida by publications such as Florida Trend and SuperLawyers. She currently serves as the Town Attorney for Lauderdale-by-the-Sea.
