WSHC+B partner Eric P. Hockman spoke to ConsumerAffairs about the dilemma flight attendants are facing regarding payment structures implemented by major airlines and the complexities surrounding their labor contracts that contribute to a discrepancy between wages earned and hours worked. 

“It is possible for a labor contract at an air carrier to pay employees, such as flight attendants, for all their work, including tasks performed before ‘flight time’ begins. But the contracts have not developed this way because there is no 9 to 5 schedule for flight crews and no reasonable way to create a ‘shift,’” Eric explained. 

A former pilot and 12-year veteran of the airline industry, Eric elaborated stating, “Flight crews simply can’t work an 8-hour, continuous shift (except on long, overseas flights), and they don’t ‘punch a clock’… they are paid for flight hours, the same way pilots are paid, because it’s a verifiable period and easy for airlines to track.”

Eric is a commercial litigator with deep knowledge about the aviation industry. His experience working as a pilot, a certified flight instructor with instrument endorsement, a certified airframe & powerplant technician, and a heavy maintenance manager, gives him a unique perspective when practicing aviation law.

In a story published by Florida Trend, Mitch explained that South Florida is moving faster than ever by promoting its micro-mobility, walkability, innovation, and aviation sectors.

“A most encouraging trend is a broad acceptance of public spending on shared mobility. We’re seeing Miami move faster than it has moved in years trying to get its South Dade TransitWay Corridor moving and trying to move forward a public-private partnership for the Beach Corridor and making serious moves on the North Corridor, as well as doing things to promote micro mobility,” Mitch said.

In addition to micro-mobility, Mitch discussed how walkability is being widely implemented in jurisdictions including Miami-Dade, Broward, Palm Beach, and Orange counties. For example, Broward County has created a funding source for all kinds of transportation improvements.

Beyond that, Mitch believes aviation trends will take off once people have their vaccinations. Another trend that is likely to come to fore is making commercial flying more luxurious or service-oriented for those who can afford it.

“Miami recently put in a request for letters of interest to develop a new VIP terminal, which would not be connected to the regular terminal,” Mitch said. “Then the fliers who were willing to pay for that experience would be able to board the first-class cabin separately right from the tarmac.”

While these mobility and travel improvements will take time, he believes that the public wants them, which may lead to bigger investments on the federal level.

WSH Litigator Timothy M. Ravich has been appointed to the American Bar Association’s House of Delegates as the representative for the Dade County Bar Association.  The appointment is for a two year term, and he will be sworn in at the end of August 2012 at the Annual Meeting in Chicago.

An AV-rated attorney, Tim is one of only 34 lawyers (top .004%) in Florida recognized as a “Florida Bar Board Certified Aviation Lawyer.”  A member of our Litigation Division and Airports and Aviation Service Group, he has extensive experience as first-chair counsel in bench and jury trials in both State and Federal court.  He has represented individuals and companies in the prosecution and defense of civil lawsuits in the areas of aviation, business and contract disputes, product liability, mediation, alternative dispute resolution, trial and appeal.  Tim published a course book titled “Aviation Law after September 11th” (Vandeplas 2010) and teaches aviation and space law as an adjunct professor at the University of Miami School of Law and Florida International University’s College of Law. Tim is also a Florida Supreme Court Certified Circuit Mediator.  He served as President of the Dade County Bar Association from 2008 through 2009, and has served on aviation-related committees for the Florida Bar Association.
