WSHC+B is proud to announce that attorneys, Anne Flanigan, Richard Rosengarten, Lindsey Ryder, Alison Smith, Lori Smith-Lalla and Alex Uribe, have been promoted to partner.

Anne represents both public and private clients in a wide range of litigation matters. Her practice includes federal civil rights matters, personal injury, contract disputes and real property claims, and she actively practices in both federal and state court. She also has an active trademark law practice that includes the registration and enforcement of trademarks for both municipal and private clients. She is based in the Fort Lauderdale office. 

Richard focuses his practice on municipal and commercial appeals and litigation. He represents businesses and public entities in commercial disputes, land use, law enforcement, discrimination and torts. His civil litigation practice also includes private sector contract disputes, complex civil litigation, construction law and real property matters. He is based in the Miami office.

Lindsey advises employers and helps them resolve employment disputes by conducting in-house investigations in response to discrimination complaints filed by employees.  She also responds to and mediates charges of discrimination filed with the Equal Employment Opportunity Commission and the Florida Commission on Human Relations. She is based in the Fort Lauderdale office.

Alison focuses her practice on labor & employment, municipal, appellate, and administrative and regulatory matters. She regularly advises and represents public and private entities in connection with workplace issues and lawsuits brought pursuant to the Americans with Disabilities Act, Title VII, the Florida Civil Rights Act, the Age Discrimination in Employment Act, and many other labor and employment laws. She is based in the Fort Lauderdale office.

Lori is a former Assistant County Attorney for Broward County and is board certified by The Florida Bar as a specialist in City, County and Local Government Law. She represents local government clients in bond financings using sophisticated financing instruments such as rate-lock agreements, swap agreements, letters of credit, delayed delivery agreements, and other derivative products. She is based in the Fort Lauderdale office.

Alex handles land use and complex development permitting matters, as well as alcoholic beverage law issues.  Prior to joining the firm, Alex worked at the City of Miami’s Planning and Zoning Department where he advised the planning, zoning and community development offices, on land use issues including permitting, covenants, affordable housing issues, impact fees and alcoholic beverage licensing. He also represents local governments in a retained counsel capacity. He is based in the Miami office.

Even life’s greatest challenges present opportunities. If you were thinking about asking local government for additional concessions for your development project, now may be a good time.
As we move closer to the gradual re-opening of the economy, businesses and developers are altering their designs and operations to accommodate the possibility of prolonged social distancing in the coming months and, if needed, in the longer term. To that end, buildings altered to enhance space, air, and light, as well as supporting areas that lend themselves better to social distancing, ventilation, and sanitizing can market these features to buyers and tenants.
Current regulations may not properly account for the new emphasis on these kinds of features. Certainly, floor area, height, and other restrictions may limit redesigns or new features and force property owners and developers into difficult choices to forego safety in favor of more traditional building design. Avoiding this result may be a good incentive for local government decision-makers to consider variances and other modifications of current restrictions. In other words, the COVID-19 outbreak and the measures identified to prevent future waves of infection provide potential new justification for seeking relief from the limitations of zoning and other land use restrictions.
Our land use and zoning practice specializes in charting a course through local government restrictions to achieve our clients’ objectives. At times, that involves variances and administrative modifications where we work within the code parameters, while at other times amending the code is more appropriate.

On Friday, March 20, 2020, the Florida Department of Business and Professional Regulation (DBPR) confirmed that the state of emergency presented by COVID-19 a/k/a novel coronavirus (see Executive Order 20-52) triggers state law protections pursuant to Section 252.363, Florida Statutes that allow permit holders to toll the expiration and even extend development orders. There is a wide variety of eligible orders including local and state-issued state building permits, zoning approvals, and certain environmental permits issued by Florida Department of Environmental Protection and local governments.

Over the years, developers, property owners, and lenders have likely become familiar with Florida law that authorized the tolling and extension of development approvals during times of emergency. DBPR’s confirmation was necessary because a 2019 amendment to the law appeared to narrowed eligible emergencies to “natural emergencies” like “a hurricane, a storm, a flood, severe wave action, a drought, or an earthquake.”

Despite DPBR’s March 20th guidance, some local governments have raised material questions about the application of the emergency extensions, particularly which development approvals can be extended and under what circumstances. One reason for local governments’ uncertainty is that the state law is very broad—it extends to just about any action that has the effect of authorizing the development of land—from demolition, site clearing, and soil work, to zoning approvals and master permits for new construction. Another cause for hesitation—and the reason the law was amended in 2019—is the fact that, in the past, extensions were authorized for events whose impact on development was not obvious and sometimes questionable, like wild fires in distant areas, the Zika virus outbreak, and the Opioid epidemic.

On behalf of our private clients, we have secured extensions of development orders for dozens of projects throughout Florida in connection with previous emergency declarations. We are currently pursuing extensions under the current state of emergency pertaining to COVID-19 a/k/a novel coronavirus. In limited circumstances where state law does not extend to a project or development order, our attorneys have developed alternative, creative solutions relying on local code provisions or the pursuit of legislative amendments to extend or even revive approvals. Further, for certain types of approvals and conditions, we have crafted and implemented strategies to combine extensions offered by both state and local jurisdictions.
