Local, state and federal officials recognize that sea-level rise presents a real danger to properties across Florida. Vulnerable areas have been identified and plans have been developed to address its effects. However, what is missing is a dedicated funding source to tackle this existential problem.

One possible solution is the creation of a resiliency utility. It would have the authority to adopt fees sufficient to plan, construct, operate, acquire and maintain systems identified in a master plan.

Funds could be collected on a property-tax bill and pledged to finance necessary capital improvements. Private entities could administer the utility to shift risk and create better efficiencies. The Florida Legislature should authorize this.

Local governments can plan for sea-level rise, but without a dedicated funding source, such plans will succumb, along with any structures, to the sea.

Chad represents developers and governmental entities in land use, zoning and general government matters. He is also a leader in the field of Property Assessed Clean Energy (PACE) programs.

As a member of the Firm’s Private Land Use and Zoning Group, Chad provides counsel to owners, developers, investors and lenders throughout South Florida in land use and zoning matters. He has represented commercial and residential developers. Chad is also a member of our Sustainable Development Group, and advises private companies and governmental agencies on how to meet higher standards in green building practices. A member of both WSH’s Private Land Use and Zoning Practice Group and Public Land Use and Zoning Practice Group, Chad has extensive experience advocating on behalf of local governments and private individuals in land use and environmental/sustainability matters.  This past October, Chad was one of three WSH attorneys who helped validate $500M in bonds on behalf of the Green Corridor PACE District, which includes portions of Miami, Coral Gables, South Miami, Pinecrest, Palmetto Bay, Cutler Bay and Miami Shores.  Chad worked with the Town of Culter Bay on its landmark Green Initiative program from its inception, drafting legislation at the state and county level and researching similar programs.  A member of WSH’s Local Government Law Division, Chad is a frequent speaker on the subject of local government law and growth management.
